It is with a heavy heart that I open this thread, but I see no other option.

DECISION

By quorum vote, the Senate decides the following:

The current Supreme Justice, Toraradical, will be dismissed with immediate effect.

If this passes the Senate must then hold elections for a replacement justice, as per the constitution.

JUSTIFICATION

Based on on the Impeachment Thread: http://www.1bcciv.com/Topic2240035-93-1.aspx. A number of citizens have taken issue with Tor's approach to the position. He has not been accountable or justified himself sufficiently. Hence his position is now untenable and would be better served by replacement.

All votes are to be cast in person with a call of Yea if in favor, Nay if not in favor, or Abstain if indifferent to the proposed decision.

My opinion on this matter has not changed. I am not siding with tora because i feel what he did was right, it is because of this forums reaction. Tora went about it wrong and he also reacted wrong but that doesnt mean the senates actions and how they went about resolving this conflict where right either. With a comunity continuously complaining of little involvement and not enough interest from people, to impeach an active Member because of a overzealous reaction is... well unsound.

Also the speed with which you move ahead with removing him is what i would consider to be a precedent. Here we have our first standard with which to consider absent Positions. We have now Established a 3 day reaction time. Where as Mr G 2-3 week absents during a very pivitol time goes by with no call or "official" thread to remove him, Tora's 3 day absents is enough?

I have no say on this matter and seeing as a majority vote has already been made Tora has lost his position. And the 1bc dGame has lost another citizen. This is i feel a greater loss than 1 thread being locked.

Hi Sword,

I do appreciate your concern here.

Here are some reasons why I feel G was not removed even though he was absent

  • There was nothing specificially requiring his personal attention that Tor could not pick up at the time
  • His absence therefore slipped "under the radar" somewhat.
  • The Senate was disbanded during his absence, so we could not vote to remove him.
  • He had returned before the time the 3rd term senate was in place.
  • Some may call this "luck"...
  • We'll try and keep an eye on such absences a bit better in future.

Here are some reasons why I felt I had to raise the vote to remove Tor

  • I had asked him to justify himself and be accountable for his actions
  • He was given 3 days (which is the minimum under the absence laws) to respond to this critical issue affecting him
  • He had signed into 1BC a couple times since then, so he was not "away"
  • Unfortunately he chose not to respond.

I don't think this was unfair, given the circumstances.

I am happy to continue the debate on this if you wish. If so I suggest you start a new thread, as this thread really should be reserved for the senate vote.

Even without PSweet's vote, we have a majority.

The 3rd Term Senate has decided that Justice Toraradical is officially and immediately removed from his position, and a replacement must be found.
